Legal II is an advanced real estate law course designed to expand a Texas real estate license holder’s understanding of legal issues encountered in complex real estate transactions. Building upon the foundational concepts introduced in Legal I, this course focuses on advanced applications of contract law, agency relationships, risk management, and statutory compliance.
Students will examine sophisticated legal topics including remedies for breach of contract, enforcement of contractual rights, material misrepresentation, disclosure obligations, escrow responsibilities, and dispute resolution. Emphasis is placed on identifying legal risk, avoiding the unauthorized practice of law, and understanding when referral to legal counsel is required.
The course also addresses regulatory compliance under the Texas Real Estate Commission, including license holder duties, ethical standards, enforcement actions, and common violations. Through practical examples and case-based discussion, students will strengthen their ability to navigate legal challenges while maintaining professional and ethical standards in real estate practice.
